Civil code - kodeks cywilny1:
Art. 931.
§ 1. In the first place the children and a spouse of the deceased are appointed to intestate inheritance in equal parts. Nevertheless the spouse’s part of inheritance cannot be smaller that ¼ of the whole inheritance.
§ 2. If deceased’s child had died before the inheritance was opened, a share in the estate due to the child shall be due to child’s descendants in equal parts. The above provision shall correspondingly apply to distant descendants.
Art. 932.
§ 1. In the absence of the descendants, a spouse and parents of the deceased are appointed to intestate inheritance.
§ 2. A share in the estate of each parent, who inherits in conjunction with a deceased’s spouse, amounts ¼ of the whole inheritance. If a paternity of such parent is not established, a share of the estate of the deceased’s mother, who inherits in conjunction with a deceased’s spouse, amounts ⅓ of the whole inheritance.
§ 3. In the absence of descendants and a spouse the whole inheritance shall be due to parents of the deceased in equal parts.
§ 4. If one of the deceased’s parents had died before the inheritance was opened a share in the estate due to the parent shall be due to parent’s siblings in equal parts.
§ 5. If any of the deceased’s siblings had died but was survived by descendants, a share in the estate due to the sibling shall be due to descendants of the sibling. A share in the estate shall be divided in accordance with rules of dividing the inheritance between distant descendants.
Art. 933.
§ 1. A share in the estate of a spouse, who inherits in conjunction with parents, siblings and descendants of the deceased’s siblings, amounts ½ of the whole inheritance.
§ 2. In the absence of the deceased’s descendants, parents, siblings and their descendants, the whole inheritance is due to a spouse of the deceased.
Art. 940.
§ 1. A spouse shall be exempted from succession if a deceased had filed for divorce or separation due to defendant's fault, and complaint was justified.
§ 2. A spouse shall be exempted from succession by wirtue of court ruling. The exeption may be demanded by any of the intestate successors inheriting in conjunction with the spouse. The exemption complain must be filed within six months since the day a plaintiff became aware of the opening of the succession and not more than a year since the opening of the succession.
Art. 953.
During the travel on polish aircraft or ship one is allowed to draw a testament in front of a first captain or the second captain of the vessel in such manner that a testator is declaring his will to the first captain or the second captain of the vessel in presence of two witnesses. The first captain or the second captain of the vessel must write down this will, giving the date of commencement and read it out loud to the testator. After abovesaid the will must be signed by the testator, both witnesses and the first captain or the second captain of the vessel. If the testator is unable to sign his will the cause must be exlained in the will. Shall maintaining of written form be impossible the testament may be commenced orally.
Art. 955.
The emergency will is void after six months since the day the circumstances justifying non-standard will form has ceased to exist unless the testor had died before due. This time limit shall be suspended for period of time during which a testator had no possibility to commence a standard testament.

Grupy/klasy spadkowe - groups of intestate successors
1st intestate successors group = a spouse and descendants (children, grandchildren…)
I grupa spadkowa = małżonek + zstępni [dzieci / wnuki]
- if a child of the deceased died before opening of the succession his/hers descendants will enter into his/her position
- spouse’s part of inheritance can’t be smaller that ¼ of the whole inheritance
2nd intestate successors group = a spouse and parents or only parents
II grupa spadkowa = małżonek + rodzice lub sami rodzice
- both living parents exclude siblings of the deceased from inheriting
- if there are both parents and a spouse, then a spouse will receive ½ of inheritance and each parent ¼
3rd intestate successors group = a spouse and one parent and siblings and sibling’s decendants
III grupa = małżonek + 1 rodzic + rodzeństwo i zstępni rodzeństwa
- if one of the parents died before opening of the succession, his/hers part of inheritance will be divided equally between siblings of the deceased
4th intestate successors group = grandparents and their descendants
IV grupa dziadkowie i ich zstępni
this group shall inherit only in case of the lack of the descendants, a spouse, parents, siblings and their descendants
5th intestate successors group = children of the deceased’s spouse
V grupa dzieci małżonka spadkodawcy czyli pasierbowie
stepchildren can inherit only if neither of the parents lived at the moment of the opening of the succession
6th intestate successors group = gmina (community,district, municipality) or StateTreasury
VI grupa = gmina lub Skarb Państwa

English version
Mr Adam Apple and Mrs Eva Apple are the young childless married couple. Eva Apple has got parents and 2 brothers, Adam Apple has got a sister and a grandfather. In April 2008 Mr & Mrs Apple began building a house. In April 2009 Adam Apple cheated on Eva with Mr Chris X, an interior designer. Two weeks afterwards Eva Apple filed for divorce due to her husband’s fault. In May 2009 Eva died in plane crash. On the day of Eva’s death the estate of The Apples was worth 200000 zł. Ewa’s parents are considering demanding exemption from succession of their son-in-law. There is no written last will. Who will inherit in abovesaid situation and what part of iheritance is due to each successor? Consider both options.

Państwo Adam i Ewa Jabłuszko są młodym bezdzietnym małżeństwem. Pani Ewa ma rodziców i 2 braci, pan Adam ma siostrę i dziadka. W marcu 2008 r. państwo Jabłuszko rozpoczynają budowę domu. W kwietniu 2009 r. pan Adam zdradza panią Ewę z panem Krzysiem, dekoratorem wnętrz. Dwa tygodnie później pani Ewa występuje o rozwód z winy męża. W maju 2009 r. pani Ewa ginie w katastrofie lotniczej. W dniu śmierci pani Ewy majątek państwa Jabłuszko jest wart 200000 zł. Rodzice Ewy zastanawiają się nad wystąpieniem z powództwem o wyłączenie zięcia od dziedziczenia. Kto i jak będzie dziedziczył po zmarłej?

Rose has got a mother and two sisters. Rose comitts suicide due to depression she developed as the effect of her unfortunate stock market investments. There is no written last will. Who will inherit in abovesaid situation and what part of iheritance is due to each successor?

Państwo Róża i Jacenty Goździkowie są młodym bezdzietnym małżeństwem. Ich majątek jest wart 64000 zł. Pan Jacenty ma dwóch braci, jego rodzice nie żyją. Pani Róża ma matkę i 2 siostry. Pani Róża w wyniku depresji, której nabawiła się wskutek nieudanych transakcji giełdowych, popełnia samobójstwo. Nie ma testamentu. Kto i jak dziedziczy po pani Róży?
KAZUS. III.
English version
Mrs Bartek O. has got 6 adult children and no other living relatives. Bartek O. went on fortnight vacation on Magagascar in July 2008. He was travelling by plane (LOT). During the flight the plane got caught into extremely unpleasent turbulences, so Bartek O. decided to write his last will and testament. He decided to give all his money to charity and disinherit his children. He declared his last will to Melissa, the stewardess, in presence of two witnesses (Mrs Jasia J. and Mrs Jan J.). Melissa wrote down Bartek’s last will, giving the date of commencement and read it out loud to the testator. After that the will was signed by Bartek O., Jasia J., Jan J. and Melissa. Samolot went safely to its destination. Unfortunatelly during his vacation Bartek O. drowned in the hotel’s swimming pool. The successors of Bartek O. challenged the will due to formal flaws. Is the will of Bartek O. valid?

Pan Bartek O. ma 6 dorosłych dzieci i żadnych innych żyjących krewnych. Pan Bartek O. w lipcu 2008 r., poleciał na wycieczkę wakacyjną, 2 tygodnie na Madagaskarze, przelot samolotem. Samolot wpadł w silne turbulencje, więc pan Bartek O. zdecydował się sporządzić swój testament. Pan Bartek O. zdecydował się wydziedziczyć swoje dzieci i oddać cały majątek na cele dobroczynne. Pan Bartek O. złożył oświadczenie woli przed stewardessą Melissą, w obecności dwóch świadków – pani Jasi J. i pana Jana J. Stewardessa Melissa spisała wolę spadkodawcy, podając datę jej spisania. Pismo to, w obecności świadków Melissa odczytała spadkodawcy, po czym pismo to zostało podpisane przez spadkodawcę, świadków oraz stewardessę Melissę. Samolot doleciał bezpiecznie do celu, ale w trakcie pobytu na Magadaskarze pan Bartek O. utonął w basenie. Spadkobiercy ustawowi (dzieci) pana Bartka wnioskują o uznanie testamentu zmarłego za nieważny z powodu braków formalnych dokumentu. Czy testamenty jest ważny?
